Important Confidentiality Notice for Illinois Endangered Individuals

Everlake Life Insurance Company (“Everlake”) respects your privacy concerns and is providing specific information regarding rights in this Important Confidentiality Notice for Illinois Endangered Individuals (“Confidentiality Notice”).  Illinois Insurance Code §355b requires health insurers to accommodate a reasonable request made by a person covered by an accident and health insurance policy to receive communications of claim-related information by alternative means or at alternative locations if the person clearly states that disclosure of the information could endanger the person. As a result, we will send claim related information for an accident and health insurance policy to a specified alternative address, telephone number or other method of contact upon receipt of a written request from an accident and health insurance policy insured stating that disclosure of all or part of the claim-related information to which the request pertains could endanger the insured or child.  Further, upon receipt of a written request from an insured covered by an accident and health insurance policy, we will not disclose to a policyholder, except with the requestor’s express consent: (1) the address, telephone number, or any other personally identifying information of the covered individual or child for whose benefit the request was made; (2) the nature of the health care services provided; (3) the name or address of the provider of the health care services; or (4) any other information from which there is a reasonable basis to believe the foregoing information could be obtained.

Important Confidentiality Notice for New York Victims of Domestic Violence and Endangered Individuals

Everlake Life Insurance Company and Everlake Assurance Company (collectively, “Everlake”) respects privacy concerns and is providing specific information regarding rights in this Important Confidentiality Notice for New York Victims of Domestic Violence and Endangered Individuals (“Confidentiality Notice”).

New York Insurance Law §2612 provides important privacy protections for victims of domestic violence and endangered individuals.  This law states that if any person covered by an insurance policy issued to another person delivers to the insurer a valid order of protection against the policyholder or other person covered by the policy, then the insurer is prohibited, for the duration of the protective order, from disclosing to the policyholder, the address and telephone number of the insured, or of any person or entity providing covered services to the insured.  The parent or guardian of a covered child may assert this right on behalf of their child, and the disclosure prohibitions will extend to the parent or guardian.

As a result, upon receipt of a valid protection order, we will not disclose, for the duration of the order, to a policyholder or another insured covered under the policy against whom the victim has a valid order of protection, except with the requestor’s express consent: (1) the address, telephone number, or any other personally identifying information of the individual who made the request, a child residing with the victim, or a child for whose benefit a request was made; or (2) the name, address, and telephone number of a person providing covered services to the victim.

New York Insurance Law §2612 also requires health insurers to accommodate a reasonable request made by a person covered by an accident and health insurance policy to receive communications of claim-related information from the health insurer by alternative means or at alternative locations if the person clearly states that disclosure of the information could endanger the person. Again, if a child is the covered person, then this right may be asserted by the child’s parent or guardian.

We will send claim related information for an accident and health insurance policy to an alternative address, telephone number or other method of contact upon receipt of a written reasonable request stating that disclosure of information could endanger the insured or a child.  Further, upon receipt of a written reasonable request stating that disclosure of information could endanger the insured of an accident and health insurance policy, we will not disclose to a policyholder or another insured covered under the same insurance policy, except with the requestor’s express consent: (1) the address, telephone number, or any other personally identifying information of the individual who made the request, any child residing with the covered individual, or child for whose benefit a request was made; (2) the nature of the health care services provided; (3) the name, address, and telephone number of the provider of the health care services; or (4) any other information from which there is a reasonable basis to believe the foregoing information could be obtained.

If you wish to initiate any of the requests discussed by this Confidentiality Notice, please send the required information to:

Everlake Privacy Office
115 Canopy Street, Suite 401
